ஆதிதிராவிட மாணவர் விடுதியில், மாணவர் கொலை செய்யப்பட்ட சம்பவத்தில், 10 லட்சம் ரூபாய் இழப்பீடு வழங்க உத்தரவிட்டதை, சென்னை உயர் நீதிமன்றம் உறுதி செய்தது.
காஞ்சிபுரம் மாவட்டம், காயர்குளத்தில், ஆதிதிராவிடர் நல விடுதியில் தங்கியிருந்த மாணவர், 2010ல் கொல்லப்பட்டார். 'விடுதிக்கு வாட்ச்மேன் மற்றும் வார்டனை நியமிக்காமல், அஜாக்கிரதையாக இருந்துள்ளனர்; 15 லட்சம் ரூபாய் இழப்பீடு வழங்க, அரசுக்கு உத்தரவிட வேண்டும்' என, உயர் நீதிமன்றத்தில், மாணவரின் தந்தை சாமிநாதன், மனு தாக்கல் செய்தார்.
மனுவை விசாரித்த உயர் நீதிமன்றம், '9 சதவீத வட்டியுடன், 10 லட்சம் ரூபாய் இழப்பீடு வழங்க வேண்டும்' என, உத்தரவிட்டது.இந்த உத்தரவை எதிர்த்து, ஆதிதிராவிடர் மற்றும் பழங்குடியினர் நலத் துறை சார்பில், மேல்முறையீடு செய்யப்பட்டது. மனுவில், 'மாணவரின் இறப்புக்கு, அதிகாரிகள் காரணமல்ல; எனவே, அரசு இழப்பீடு வழங்க வேண்டும் என்பதை ஏற்க முடியாது' என, கூறப்பட்டது.
மனுவை விசாரித்த, நீதிபதிகள் சுதாகர், வைத்தியநாதன் அடங்கிய, 'டிவிஷன் பெஞ்ச்' பிறப்பித்த உத்தரவு:விடுதியில் தங்கியிருக்கும் மாணவர்களை கவனிக்க, வாட்ச்மேன் இல்லை. மாணவரின் தந்தை ஒருவர், வார்டனாக இருந்துள்ளார். விடுதி வளாகத்துக்குள் எது நடந்தாலும், அதற்கு வார்டன் அல்லது அதிகாரிகள் தான் பொறுப்பேற்க வேண்டும்.
விடுதியில் தங்கியிருக்கும் மாணவர்களுக்கு, பாதுகாப்பு மற்றும் உள்கட்டமைப்பு வசதிகளை வழங்க வேண்டியது, அரசின் கடமை.தங்களுக்கு பொறுப்பில்லை என, அதிகாரிகள் தட்டிக் கழித்து விட முடியாது. விடுதி வளாகத்துக்குள் சம்பவம் நடந்துள்ளதால், அரசு இழப்பீடு வழங்க வேண்டும் என, தனி நீதிபதி உத்தரவிட்டிருப்பது சரி தான்.
மேல்முறையீடு மனு தள்ளுபடி செய்யப்படுகிறது. 10 லட்சம் ரூபாய் இழப்பீடு மற்றும் வட்டி வழங்கும்படி பிறப்பித்த உத்தரவு, உறுதி செய்யப்படுகிறது.இவ்வாறு டிவிஷன் பெஞ்ச் உத்தரவிட்டுள்ளது.

Nearly six years after an ITI student was found dead inside a government-run hostel for SC/ST students, the Madras high court has awarded Rs 10 lakh compensation to the boy's father saying the government was vicariously responsible for the incident.
"In the absence of providing any security, much less, adequate security, the authorities cannot shirk their responsibility by merely stating that vicarious liability cannot be fixed on them. As rightly held by the learned single judge, the authorities are vicariously liable to pay compensation to the father of the deceased student herein, more so when the occurrence had taken place within the hostel premises," said a division bench of Justice R Sudhakar and Justice S Vaidhyanathan,

confirming a single judge order delivered in November 2011.

K Saminathan, a first year student of Kamatchi Industrial Training Institute, Sekkuppettai, was staying at an adi dravidar welfare hostel at Kayarkulam in Kancheepuram district. He was murdered on October 1, 2010 and a case was registered against another student who also stayed in the said hostel.
The boy's father moved the high court seeking Rs 15 lakh compensation, alleging that due to the callous attitude on the part of authorities the security in the hostel had been compromised, resulting in the death of his son. A single judge held that the authorities were indeed liable to pay compensation and said Rs 10 lakh should be paid with at 9% annual interest.

The government filed the present appeal saying vicarious liability could not be fastened on authorities and that they could not be held responsible for the death of a student.

Rejecting the appeal, the bench said: "The single judge has clearly held that no watchman was appointed by the government to look after the security of students staying at the hostel. Further, it has also been found that the warden, a local, was the parent of one of the inmates of the hostel."

The hostel is primarily intended for SC/ST students who come from oppressed strata of society, they said, adding: "It is the paramount duty of any welfare state to provide security to the oppressed class. Therefore, it is the duty of the government to provide all necessary facilities, infrastructure as well as security for the students staying in the hostel."
